Projects subject to various forms of governmental regulation require that the owner make such disclosures about the site as are appropriate to defining the site in terms of the governing regulations. Regulatory processes require a “permitting” process, in which the site owner is obligated to detect and report conditions in the ground (and often in the immediate surroundings of the site) as may affect the project in terms of activities and used of the site subject to regulatory oversight. Full Disclosure is an owner compliance-obligation of most regulatory land-use permits. The owner is charged with selecting a competent site (and waste, in many environmental regulatory permits) characterization consultant. The owner is charged with providing such historic document as would be expected to be held by most long-term property owners now wishing to honor their obligations under environmental legislation and regulation and to provide such documentation to the consultant so that the required pre-development or existing land-use remediation conditions can be accommodated by engineered design. Sites that are characterized without appropriate disclosure may contain certain undiscovered or otherwise undisclosed geologic conditions that will compromise the selected engineered design during the performance of the project objectives during the project lifetime.
